In its new version of FTC regulations for Online Advertising Disclosure Guidelines, the FTC stops short of enforcing an across-the-board decree for necessary mobile version of websites. The report entitled “.com Disclosures: How to Make Effective Disclosures in Digital Advertising”, will force online advertisers to revise their current disclosure policies.
“…unless a Website defaults to a mobile-optimized (or similarly responsive) version, advertisers should design the Website so that any necessary disclosures are clear and conspicuous, regardless of the device on which they are displayed… if a disclosure is too small to read on a mobile device and the text of the disclosure cannot be enlarged, it is not a clear and conspicuous disclosure.”
Digital advertisers are encouraged to reconsider their mobile optimized sites and pay particular attention to multi-columns layouts where placing the disclosure in a different column would require horizontal scrolling making it less likely that consumers would notice the disclosure.
This basically opens up the possibility that a consumer could buy your product on their mobile phone or tablet and have grounds to claim that the purchase was unfair and misleading, because disclaimers were not clear and obvious, leaving you vulnerable to legal action.
With mobile purchasing now nearly on par with desktop purchasing, this new standard could impact more than half your digital sales. That’s potentially a big liability that can easily be avoided with the right advertizing strategy.
